1Acceptance of Terms
These Terms of Service ("Terms"), together with our Privacy Policy and any supplemental policies referenced herein (collectively, the "Agreement"), constitute a legally binding contract between you ("User", "you", or "your") and TopperSquare ("Company", "we", "us", or "our"), the operator of the website accessible at https://www.toppersquare.com and any associated subdomains or applications (the "Platform").
By registering an account, accessing any content, attempting any test, or otherwise using the Platform in any way, you confirm that: (a) you have read, understood, and agree to be bound by this Agreement; (b) you have the legal capacity to enter into a binding contract; and (c) you are at least 13 years old or, if younger, have obtained verifiable parental or guardian consent.
2Definitions
For the purposes of this Agreement, the following terms carry the meanings set out below:
- "Platform" means the TopperSquare website, web application, APIs, and any related services.
- "Content" means all text, questions, explanations, analytics, images, and other materials made available on the Platform.
- "User Content" means any material you submit to the Platform, including question reports and feedback.
- "Subscription" means a paid plan granting access to premium features for a defined period.
- "Personal Data" has the meaning given under the Information Technology (Amendment) Act 2008 and the Digital Personal Data Protection Act 2023.
3Accounts & Eligibility
Registration
To access the Platform's features you must register an account using a valid Indian mobile phone number. You must provide accurate and current information and keep it updated. One account is permitted per person; creating multiple accounts for any purpose is prohibited.
Account Security
You are solely responsible for all activity that occurs under your account. Keep your OTP and session credentials confidential. Notify us immediately at support@toppersquare.com if you suspect unauthorised access. We are not liable for losses resulting from your failure to keep credentials secure.
Age
The Platform is intended for users aged 13 and above. If you are under 18, you represent that a parent or legal guardian has reviewed and consented to this Agreement and your use of the Platform.
4Permitted & Prohibited Use
Permitted Use
You may use the Platform solely for personal, non-commercial educational preparation for NEET and related competitive examinations, in compliance with this Agreement and all applicable Indian laws.
Prohibited Conduct
You must not, and must not attempt to:
- Scrape, crawl, data-mine, or systematically extract Content from the Platform by automated means without our prior written consent.
- Copy, reproduce, distribute, or publicly display any questions, answer keys, or explanations outside the Platform.
- Share account credentials, sell access to your account, or allow any other person to use your account.
- Submit false question reports, spam, or abusive content.
- Attempt to reverse-engineer, decompile, or derive the source code of the Platform.
- Introduce viruses, malware, or any code intended to interfere with the Platform's operation.
- Use the Platform to impersonate any person or entity or misrepresent your affiliation.
- Circumvent any technical measures designed to restrict access or enforce these Terms.
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
Violation of any prohibition above may result in immediate account suspension or termination and, where appropriate, referral to law enforcement authorities.
5Intellectual Property
All Content on the Platform — including but not limited to practice questions, explanations, solutions, analytics algorithms, software code, trademarks, logos, and visual design — is the exclusive property of TopperSquare or its licensors and is protected under the Copyright Act 1957 (India) and applicable international intellectual property treaties.
No Content may be reproduced, republished, distributed, transmitted, stored in a retrieval system, or otherwise exploited without our prior express written permission. Requests for licensing or academic use should be directed to support@toppersquare.com.
You retain ownership of any original User Content (such as question reports or feedback) you submit but grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, and incorporate such User Content to improve the Platform.
6Subscription & Payments
Free Tier
Core Platform features are available without charge. We reserve the right to modify what features are included in the free tier with reasonable advance notice.
Premium Plans
Certain features require a paid Subscription. Subscription pricing, billing cycles, and inclusions are described on the Pricing page at https://www.toppersquare.com. All prices are in Indian Rupees (INR) and include applicable Goods and Services Tax (GST) unless otherwise stated.
Payment Processing
Payments are processed by Razorpay Software Private Limited ("Razorpay"), a licensed payment aggregator regulated by the Reserve Bank of India. We do not store your card or banking details. By purchasing a Subscription you agree to Razorpay's Terms of Service and Privacy Policy in addition to ours.
Auto-Renewal
Subscriptions renew automatically at the end of each billing cycle unless cancelled. You authorise us to charge the same payment method used at initial purchase for each renewal. You may cancel auto-renewal at any time through your Account Settings.
Price Changes
We may modify Subscription pricing. If you hold an active Subscription, we will notify you at least 14 days before any price change takes effect. Continued use after the price change constitutes acceptance of the new pricing.
7Refund Policy
Why We Do Not Offer Refunds
TopperSquare is a high-investment, infrastructure-intensive platform. Every rupee collected from Subscriptions is directly reinvested into delivering a world-class preparation experience to every student on the platform — including the thousands who access it entirely for free. Offering refunds would undermine our ability to sustain and continuously improve this ecosystem.
To be fully transparent with our users, below is a non-exhaustive overview of the significant and ongoing costs that make the TopperSquare platform possible:
- Cloud Infrastructure & Hosting: The platform runs on enterprise-grade cloud servers that guarantee high availability, low latency, and real-time data processing — even during peak exam periods when thousands of students attempt tests simultaneously. These costs are incurred on a continuous, per-second basis regardless of individual usage.
- Database & Storage Systems: We maintain a secure, replicated database infrastructure to store over 32,000+ questions, detailed per-student performance records, session logs, and analytics data. Maintaining data integrity, automated backups, and zero-downtime failover entails substantial recurring costs.
- Question Authoring, Curation & Quality Review: Every question on the platform is authored, reviewed, cross-referenced against the NCERT curriculum and NTA patterns, and verified by subject-matter experts. Building and maintaining a question bank of this scale and accuracy requires continuous human effort and expert remuneration.
- AI & Machine Learning Systems: Our adaptive test engine, weakness-detection algorithms, and score prediction models require substantial computational resources and ongoing model training. These systems run 24/7 in the background to deliver personalised insights to every student.
- Payment Processing & Security Compliance: Each transaction processed through Razorpay incurs a processing fee paid to the payment gateway. Additionally, we invest in SSL/TLS encryption, PCI-DSS-adjacent security standards, OTP infrastructure, and regular third-party security audits — none of which are reversible upon a refund request.
- Product Development & Engineering: A full-time engineering team continuously builds, tests, and ships new features, fixes reported bugs, updates content for syllabus changes, and ensures cross-device compatibility. This work does not pause between your subscription start date and any refund request.
- Free-Tier Subsidisation: A significant portion of the platform's features — including the entire question bank, chapter-wise tests, PYQ sets, and basic analytics — is provided completely free of charge to students who cannot afford a premium plan. Subscription revenue directly subsidises this free access, making TopperSquare equitable for all NEET aspirants across India.
Given these irreversible, ongoing cost commitments, it is not economically or operationally feasible for us to honour refund requests after a Subscription payment has been processed. The moment your payment is confirmed, infrastructure resources are allocated, your account is upgraded, and premium features are made available to you — all of which represent real costs that cannot be un-incurred.
No Refunds — All Plans
All Subscription payments — whether for monthly, quarterly, semi-annual, or annual plans — are final, non-refundable, and non-transferable. This policy applies regardless of:
- Whether you used the premium features or not after purchase.
- Whether you found alternative study resources after subscribing.
- Whether your personal circumstances changed (e.g., withdrew from NEET, changed academic plans).
- Whether you experienced technical issues that were not caused by a failure on our part.
- The time elapsed since the subscription was purchased, provided you were not denied access.
Exceptions — Service Failure by {PROJECT_NAME}
The sole exception to our no-refund policy is in the event of a documented, material service failure attributable exclusively to TopperSquare — for example, a confirmed platform-wide outage lasting more than 72 consecutive hours where premium features were completely inaccessible, and where no reasonable workaround was available. In such exceptional circumstances, we will evaluate refund or account credit requests on a case-by-case basis at our sole discretion. To initiate such a claim, email support@toppersquare.com with your registered phone number, Razorpay order ID, and a description of the issue. We reserve the right to determine whether a qualifying service failure occurred.
Chargebacks & Payment Disputes
Initiating a chargeback or payment dispute with your bank or card issuer without first contacting us constitutes a breach of this Agreement. If a chargeback is filed, we reserve the right to suspend or permanently terminate your account pending resolution and to contest the chargeback with the full documentation of your acceptance of this no-refund policy at the time of purchase.
Free Plan — No Charge, No Refund Applicable
If you are using the free tier of TopperSquare, no payment has been collected from you, and accordingly no refund scenario arises. All core features of the free plan remain accessible without any financial commitment on your part.
Contact Before Disputing
If you have a concern about your Subscription or billing, we strongly encourage you to contact us at support@toppersquare.com before initiating any bank or card dispute. Many concerns — such as accidental double-charges, failed transactions, or billing confusion — can be resolved promptly and amicably without invoking formal dispute mechanisms.
8Privacy Policy
This Privacy Policy describes how TopperSquare collects, uses, stores, and protects your personal information in accordance with the Information Technology Act 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011, and the Digital Personal Data Protection Act 2023 (DPDPA).
Data We Collect
- Identity & Contact Data: mobile phone number, display name, email address (optional).
- Academic Data: enrolled course/stream, target exam year.
- Performance Data: test scores, accuracy rates, per-question timing, streaks, and session logs.
- Payment Data: subscription status, Razorpay transaction IDs (we do not store card details).
- Device & Usage Data: IP address, browser type, device type, pages visited, session timestamps.
- User-Generated Content: question reports, feedback messages.
How We Use Your Data
- To create and maintain your account and authenticate your identity via OTP.
- To personalise your practice experience and generate performance analytics.
- To process payments and manage your Subscription.
- To respond to support requests and question reports.
- To send transactional communications (OTPs, subscription confirmations, account alerts).
- To improve Platform quality by analysing aggregate, anonymised usage patterns.
- To comply with applicable legal and regulatory obligations.
Legal Basis for Processing
We process your personal data on the following bases: (a) contract performance — to provide the services you've registered for; (b) legitimate interest — to maintain platform security and improve our services; (c) legal obligation — where required by Indian law; (d) consent — where you have given explicit consent (e.g., optional marketing communications).
Data Sharing
We do not sell, rent, or trade your personal data to any third party. We share data only with:
- Razorpay — for payment processing (governed by their own privacy policy).
- Supabase Inc. — for secure cloud database hosting of your account and performance data (data stored in the EU-West region under Supabase's Data Processing Agreement).
- Law enforcement or regulatory bodies — where required by a valid legal order under Indian law.
Data Retention
We retain your account and performance data for as long as your account is active, plus a period of up to 3 years after account closure for audit and legal compliance purposes. Payment records are retained for 8 years as required by Indian accounting regulations.
Your Rights
Under the DPDPA and applicable laws, you have the right to:
- Access the personal data we hold about you.
- Correct inaccurate or incomplete personal data.
- Request erasure of your personal data (subject to legal retention requirements).
- Withdraw consent for optional data processing at any time.
- Nominate a person to exercise your rights on your behalf.
- Lodge a complaint with the Data Protection Board of India (once operational).

Data Security
We implement industry-standard security measures including TLS encryption in transit, AES-256 encryption at rest (via Supabase), Row-Level Security (RLS) policies, and OTP-based authentication. While we take all reasonable steps, no system is 100% breach-proof. Please notify us immediately if you suspect any unauthorised access to your account.
Children's Privacy
Users under 13 are not permitted to register without verifiable parental consent. We do not knowingly collect personal data from children under 13. If we become aware that we have done so without proper consent, we will delete such data promptly.
10Disclaimer & Limitation of Liability
THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT ANY QUESTION, ANSWER KEY, OR EXPLANATION IS COMPLETELY ACCURATE.
TopperSquare is an educational practice tool and does not guarantee any specific NEET rank, score improvement, or admission outcome. Results depend on individual effort, preparation quality, and factors beyond our control.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, TOPPERSQUARE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
11Indemnification
You agree to indemnify, defend, and hold harmless TopperSquare and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your use of the Platform in breach of this Agreement; (b) your infringement of any third-party rights; or (c) any false or misleading information you provide.
12Termination
By Us
We reserve the right to suspend or permanently terminate your account, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or if your conduct endangers the integrity of the Platform or other users.
By You
You may delete your account at any time by emailing support@toppersquare.com with the subject line "Account Deletion Request". Deletion requests are processed within 30 days.
Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Sections covering intellectual property, disclaimer, indemnification, and governing law survive termination.
13Changes to These Terms
We may update this Agreement from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify registered users by posting a prominent notice on the Platform or, where feasible, by sending an SMS/email notification. The "Last updated" date at the top of this page will always reflect the most recent revision.
Your continued use of the Platform after the updated Agreement takes effect constitutes your acceptance of the new terms. If you do not agree to the updated terms, you must stop using the Platform and may request account deletion.
14Governing Law & Disputes
This Agreement is governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles. The courts of West Bengal, India shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement.
Before initiating any legal proceedings, you agree to attempt in good faith to resolve any dispute informally by contacting us at support@toppersquare.com with a written description of the dispute. We will endeavour to resolve such disputes within 30 days.
